It's all in the timing.


Hey all,

Remember a long time ago, when I wrote about how the song "Happy Birthday" was still technically under copyright?

Looks like I spoke (typed?) too soon.

The TL/DR version:

Warner Music never actually had copyright on "Happy Birthday", and the sisters may have not actually had it to begin with.  Doesn't necessarily mean that it's in the public domain, and it could be an orphan work.
NO word on whether Warner will refund the millions they have collected in royalties.



QUIZ:
In related news, the US 9th Circuit Court of Appeals recently ruled that a fictional vehicle could be covered by copyright, as if it were a character.  What is that vehicle?
